By accessing or using the NutriScan360 application, you agree to be bound by these Terms of Service ('Terms'). If you do not agree to any part of these Terms, you may not access or use the service. These Terms constitute a legally binding agreement between you and Travus Tech Inc. ('Company', 'we', 'us', 'our'). By continuing to use NutriScan360, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.
NutriScan360 is a mobile nutritional analysis application that allows users to scan food product barcodes to obtain nutritional information, ingredient analysis, AI-generated health reviews, Nutri-Score and NOVA ratings, diet compatibility checks, and personalized allergen warnings. The service is provided 'as is.' We offer a free plan with unlimited barcode scanning and 3 full AI analyses per day (tracked server-side by user account or device identifier), and premium subscription plans with unlimited AI analyses. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.
THE NUTRITIONAL ANALYSES, HEALTH SCORES, INGREDIENT RATINGS, AND RECOMMENDATIONS PROVIDED BY NUTRISCAN360 ARE GENERATED BY AUTOMATED SYSTEMS AND AI ALGORITHMS. THIS INFORMATION DOES NOT CONSTITUTE AND SHOULD NOT BE INTERPRETED AS MEDICAL, HEALTH, DIETARY, NUTRITIONAL, OR OTHER PROFESSIONAL ADVICE OF ANY KIND. Always consult a physician, registered dietitian, or qualified healthcare professional before making any dietary or health decisions. NutriScan360 is not liable for any health consequences, illness, allergic reactions, injuries, or damages resulting from use of or reliance on information provided by the app. You assume full responsibility for your use of the nutritional information presented.
Nutritional and product data is sourced from third parties including Open Food Facts, Nutritionix, Spoonacular, and USDA FoodData Central. While we strive to present accurate information, we make no guarantees regarding the accuracy, completeness, timeliness, or reliability of any product information. Product formulations may change without prior notice. You should always verify physical product labels, especially if you have food allergies or health conditions. The Company assumes no liability for errors, omissions, or inaccuracies in data provided by external sources.
Free Plan: The free plan provides unlimited barcode scanning and 3 full AI health analyses per day, with no expiration. After reaching the daily limit of 3 full analyses, you may continue scanning products but will receive analyses in basic mode (score and verdict only, without detailed tips or alerts). The daily limit resets at midnight (UTC) and is tracked server-side by user account or device identifier. Premium Plan: Premium plans provide unlimited full AI analyses and personalized allergen and diet alerts. They are billed according to the selected period (monthly or annual) and automatically renew at the end of each billing period until cancelled. Prices are subject to change with reasonable advance notice. All payments are processed by the Apple App Store or Google Play Store, as applicable. We do not store payment data. Refunds are governed by the applicable app store's policies. Referral Program: Users may claim a valid referral code to receive 7 (seven) consecutive days of free Premium access. Each user may claim only one referral reward. Codes have a maximum usage limit and must be active at the time of redemption. Premium access obtained through a referral cannot be combined, stacked, or extended by claiming additional codes. After the 7-day period expires, the account automatically reverts to the free plan.
You may cancel your subscription at any time through your account settings in the Apple App Store or Google Play Store. Cancellation takes effect at the end of the current billing period, and you will retain access to premium features until that date. After cancellation, your account will automatically revert to the free plan. For Apple-managed plans, go to Settings > [your name] > Subscriptions on your iOS device. For Google-managed plans, go to Google Play > Subscriptions.
The NutriScan360 application, including all its source code, design, graphics, logos, text, ingredient database, analysis algorithms, and other content, is the exclusive property of Travus Tech Inc. and is protected by copyright, trademark, trade secret, and other intellectual property laws of the United States and internationally. You are granted a limited, non-exclusive, non-transferable, revocable license to use the application solely for personal, non-commercial purposes in accordance with these Terms. You may not: (a) reproduce, distribute, modify, or create derivative works; (b) reverse engineer, decompile, or disassemble the application; (c) use the application for commercial purposes without written authorization; (d) remove intellectual property notices from the application.
You agree not to: (a) use the service for any illegal purpose or in violation of any applicable law or regulation; (b) attempt to gain unauthorized access to any part of the service, its servers, or connected networks; (c) use automated systems, bots, scripts, or scraping tools to access the service in excessive volume; (d) interfere with, overload, or damage the service's infrastructure; (e) impersonate another person or entity; (f) transmit viruses, malware, or malicious code; (g) use the service to commercially compete with Travus Tech Inc. without authorization; (h) circumvent security measures or usage limits; (i) collect or store other users' personal data.
NutriScan360 integrates with third-party services including RevenueCat (subscription processing), Apple App Store and Google Play Store (distribution and payments), Open Food Facts, Nutritionix, Spoonacular, and USDA (nutritional data). Use of these services is subject to each third party's respective privacy policies and terms of service. We are not responsible for the practices, policies, or content of third-party services. Links or integrations with external services do not imply our approval or endorsement.
We may suspend or terminate your access to the service immediately, without notice, for any violation of these Terms or for other reasons at our sole discretion. You may discontinue use of the service at any time by uninstalling the application. Upon termination, provisions relating to intellectual property, disclaimer of warranties, limitation of liability, indemnification, and governing law shall survive.
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE,' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE RESULTS OBTAINED FROM USE OF THE SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAVUS TECH INC. AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE; (B) ANY CONDUCT OR CONTENT OF THIRD PARTIES ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU IN THE LAST SIX (6) MONTHS OR USD $50, WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless Travus Tech Inc. and its officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any claim that your content or use caused harm to a third party.
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or use of the service shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), in Atlanta, Georgia. YOU AND THE COMPANY WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTION LITIGATION. Notwithstanding the above, either party may seek injunctive or other urgent equitable relief in any court of competent jurisdiction to protect intellectual property rights.
We reserve the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. If we make material changes to these Terms, we will notify you through the application or by email, as applicable, at least 30 days in advance. Your continued use of the service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the service.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The Company's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the service and supersede all prior agreements. You may not assign your rights or obligations under these Terms without our prior written consent.
